These Terms of Service (“Terms”) govern your access to and use of CounterNest, including our website visitor counters, traffic analytics, uptime monitoring, website security reputation monitoring, notifications, reports, APIs, scripts, widgets, and other related services.

By accessing or using CounterNest, you agree to these Terms. If you do not agree, you should not use the service.

1. About CounterNest

CounterNest provides website analytics and monitoring tools designed to help website owners understand website activity and identify operational or security-related issues.

Our services may include:

  • Online visitor tracking
  • Active-page statistics
  • Country and referral statistics
  • Traffic reports and graphs
  • Website uptime monitoring
  • HTTP status monitoring

CounterNest may add, modify, restrict, or discontinue features over time.

2. No Account Required for Certain Services

Some CounterNest services may be available without creating a user account.

For example, you may be able to create a website counter or monitor and receive a unique identifier, embed code, or private management link.

You are responsible for protecting private management links, monitor tokens, API credentials, and other access information provided to you.

Anyone with access to a private management link may potentially be able to access or manage the associated service. Do not publish or share private links unless you intend to grant access.

3. Website Counters

CounterNest may provide scripts or code that you can embed on a website to measure visitor activity.

By installing CounterNest code, you authorize CounterNest to receive and process technical information generated when visitors access pages containing that code.

Depending on the service, this may include information such as:

  • Page URLs
  • Page titles
  • Referral information
  • Approximate visitor location
  • Browser and device information
  • Visit timestamps
  • Online status
  • Technical visitor identifiers
  • Other information reasonably necessary to provide traffic analytics

CounterNest counters may be portable and capable of operating on different websites.

You are responsible for ensuring that you have the legal authority to install CounterNest tracking technology on any website where you use it.

4. Website Monitoring

CounterNest may automatically request URLs submitted for monitoring.

These requests are used to determine information such as:

  • Whether a website is available
  • HTTP response codes
  • Response times
  • Downtime
  • Recovery
  • Changes in website status

By submitting a URL for monitoring, you authorize CounterNest to make automated requests to that URL at scheduled intervals.

You must not use CounterNest monitoring in a manner intended to overload, attack, disrupt, probe, circumvent, or damage another website or network.

5. Deceptive and Security Reputation Monitoring

CounterNest may provide monitoring intended to identify supported website reputation warnings associated with phishing, deceptive content, social engineering, malware, unwanted software, or similar security threats.

CounterNest may use third-party security and reputation providers to perform these checks.

Security monitoring is provided for informational purposes.

A SAFE, NO WARNING DETECTED, or similar result does not guarantee that a website:

  • Is secure
  • Has not been compromised
  • Contains no malware
  • Contains no phishing content
  • Has no vulnerabilities
  • Will not receive a security warning later

Likewise, an unsafe or deceptive result may originate from a third-party reputation provider and may occasionally be inaccurate, delayed, incomplete, or outdated.

CounterNest is not a substitute for antivirus software, malware scanning, security audits, firewalls, backups, vulnerability management, or professional cybersecurity services.

6. Monitoring Is Not Guaranteed

We aim to provide useful and reliable monitoring, but CounterNest does not guarantee continuous or error-free monitoring.

Monitoring may be affected by:

  • CounterNest server outages
  • Internet connectivity problems
  • DNS failures
  • Hosting provider issues
  • Firewalls
  • Rate limiting
  • Bot protection
  • Content delivery networks
  • Geographic routing
  • Third-party API outages
  • Scheduled maintenance
  • Software errors
  • Network congestion
  • Website configuration
  • Security systems blocking monitoring requests

A website may therefore be available even when CounterNest reports a failure, or unavailable even when CounterNest has not yet detected the outage.

7. Alerts and Notifications

CounterNest may provide alerts through email, browser notifications, supported mobile web notifications, or other channels.

Notifications may include events such as:

  • Website downtime
  • Website recovery
  • Security reputation warnings
  • Removal of previously detected warnings
  • Important monitoring changes

Alerts are provided on a best-effort basis.

We do not guarantee that an alert will be delivered immediately or at all. Delivery can be affected by email providers, spam filtering, push notification providers, browser permissions, device settings, network problems, third-party outages, and other circumstances outside our control.

You should not rely on CounterNest as your only method of detecting critical outages or security incidents.

8. Email Verification

CounterNest may require verification before sending monitoring alerts to an email address.

You may only configure notifications to email addresses that you own, control, or have authorization to use.

You must not use CounterNest to send unwanted, misleading, abusive, or unsolicited notifications to other people.

9. Acceptable Use

You agree to use CounterNest lawfully and responsibly.

You must not use CounterNest to:

  • Violate applicable laws or regulations
  • Monitor systems in a manner that constitutes an attack or unauthorized security testing
  • Intentionally overload websites or servers
  • Circumvent access controls
  • Conduct denial-of-service activity
  • Distribute malware
  • Facilitate phishing or fraud
  • Send spam or unwanted notifications
  • Attempt unauthorized access to CounterNest systems
  • Interfere with CounterNest infrastructure
  • Manipulate CounterNest statistics through automated or fraudulent traffic
  • Abuse monitoring endpoints
  • Scrape CounterNest excessively
  • Reverse engineer protected portions of the service where prohibited by law
  • Impersonate CounterNest or falsely claim affiliation with us
  • Use CounterNest in a way that could damage the service or other users

We may restrict or terminate access when we reasonably believe CounterNest is being abused.

10. Your Responsibilities

You are responsible for websites, URLs, email addresses, and other information you submit to CounterNest.

You are also responsible for ensuring that your use of CounterNest complies with applicable:

  • Electronic communications laws

  • Consumer protection requirements

If your website requires visitor consent before analytics technologies can operate, you are responsible for implementing the necessary consent mechanism.

CounterNest does not provide a guarantee that installing our service automatically makes your website compliant with any law or regulation.

11. Third-Party Services

CounterNest may depend on third-party services for certain functionality.

These may include providers of:

  • Security reputation information
  • Hosting infrastructure
  • Email delivery
  • Push notifications
  • DNS services
  • Content delivery
  • Analytics
  • Network infrastructure

Third-party services are governed by their own terms and policies.

We are not responsible for outages, errors, policy changes, inaccurate information, discontinued services, rate limits, or other actions of third-party providers.

12. Accuracy of Analytics

Traffic statistics and analytics provided by CounterNest are estimates based on information available to our systems.

Visitor counts can be affected by factors such as:

  • Ad blockers
  • JavaScript restrictions
  • Browser privacy protections
  • Network configurations
  • Bots
  • Caching
  • Duplicate visitors
  • VPNs and proxies
  • IP geolocation accuracy
  • Tracking prevention technologies
  • Visitors closing pages before tracking completes

CounterNest therefore does not guarantee that visitor statistics will exactly match server logs, other analytics platforms, advertising platforms, or another measurement service.

13. Availability of the Service

We may modify, update, suspend, restrict, or discontinue any part of CounterNest.

We may also impose reasonable limits relating to:

  • Number of counters
  • Number of monitors
  • Monitoring frequency
  • Traffic volume
  • Data retention
  • API requests
  • Notification volume
  • Available features

Where practical, we may provide notice of significant changes, but we are not required to provide advance notice in every situation.

14. Free and Paid Services

CounterNest may offer free services, paid services, or both.

Features currently offered without charge may become subject to limits or paid plans in the future.

If paid services are introduced, applicable prices, billing periods, renewal terms, cancellation rules, and other payment conditions will be disclosed before purchase.

We will not charge you merely because a previously free feature becomes paid unless you affirmatively purchase or subscribe to the paid service.

15. Intellectual Property

CounterNest and its associated software, branding, logos, designs, interfaces, documentation, original content, and technology are owned by CounterNest or its licensors and are protected by applicable intellectual property laws.

CounterNest grants you a limited, revocable, non-exclusive, non-transferable right to use our services in accordance with these Terms.

The embed code we provide may be copied and installed on websites for the purpose of using CounterNest.

This permission does not grant you ownership of CounterNest software or intellectual property.

16. CounterNest Branding

CounterNest widgets or embed codes may contain attribution identifying CounterNest as the provider of the service.

You must not deliberately misrepresent CounterNest services as technology created or operated by another company.

Where CounterNest provides an option to hide the visual counter or attribution, you may use that option according to the functionality provided by the service.

17. Data and Monitoring History

CounterNest may retain analytics, monitoring checks, incident histories, aggregated statistics, and related information for periods we determine are reasonably necessary to operate the service.

We may establish or change retention limits.

Older records may be deleted, summarized, or aggregated.

You should not use CounterNest as your sole permanent archive of important business or security information.

18. Suspension and Termination

We may suspend, restrict, delete, or terminate access to CounterNest services if we reasonably determine that:

  • These Terms have been violated
  • The service is being abused
  • Activity creates a security risk
  • Activity threatens our infrastructure
  • Monitoring creates excessive load
  • Fraudulent or malicious activity is occurring
  • We are legally required to do so

We may also remove abandoned data or monitors in accordance with our retention policies.

19. Disclaimer of Warranties

To the maximum extent permitted by applicable law, CounterNest is provided on an “as is” and “as available” basis.

We do not warrant that:

  • CounterNest will always be available
  • Monitoring will be uninterrupted
  • Every outage will be detected
  • Every notification will be delivered
  • Visitor counts will be perfectly accurate
  • Security reputation information will always be accurate
  • Every deceptive or malicious website will be identified
  • A website marked safe is actually free from security threats
  • Errors will always be corrected immediately

You use CounterNest at your own discretion and risk.

20. Limitation of Liability

To the maximum extent permitted by applicable law, CounterNest and its owners, operators, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of or inability to use CounterNest.

This includes, without limitation, losses resulting from:

  • Website downtime
  • Missed downtime alerts
  • Delayed notifications
  • Security incidents
  • Undetected malware or phishing
  • Incorrect security classifications
  • Lost traffic
  • Lost revenue
  • Lost profits
  • Lost customers
  • Lost data
  • Business interruption
  • Decisions based on analytics or monitoring information

Where liability cannot legally be excluded, our liability will be limited to the maximum extent permitted by applicable law.

21. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless CounterNest and its operators from claims, damages, losses, liabilities, and reasonable expenses arising from your unlawful use of CounterNest, violation of these Terms, violation of another person’s rights, or unauthorized installation or use of CounterNest services.

22. Privacy

Our collection and processing of information are also governed by the CounterNest Privacy Policy.

You should review the Privacy Policy before using CounterNest, particularly if you intend to install our traffic counter on a website used by other people.

23. Changes to These Terms

We may update these Terms as CounterNest develops.

When changes are made, we may update the Last Updated date at the beginning of this document.

For material changes, we may provide additional notice where reasonably appropriate.

Your continued use of CounterNest after revised Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.

24. Governing Law

These Terms will be governed by the laws applicable to the entity operating CounterNest, without regard to conflict-of-law principles, except where mandatory consumer protection laws provide otherwise.
